Participant Agreement, Assumption of Risk, Release of Liability, and Indemnification Agreement

The agreement below applies to Millfort Tactical activities. Review this agreement before booking. Print or save a copy and complete it with Millfort staff at check-in before participation. The online intake form does not collect your signature.

1. Agreement and Covered Parties

In consideration for being permitted to enroll in, attend, observe, travel with, volunteer for, or participate in any Millfort Tactical activity, I enter into this Agreement with Millfort Group LLC, doing business as Millfort Tactical (collectively, “Millfort”). “Released Parties” means Millfort; its parent, affiliates, divisions, owners, members, managers, officers, employees, instructors, contractors, volunteers, agents, sponsors, event hosts, landowners, facility operators, equipment providers, vehicle owners or drivers, and each of their respective insurers, successors, and assigns. A facility, outfitter, range, drop zone, carrier, or other provider may require a separate agreement, which remains independently effective.

This Agreement applies to the event or course identified in the participant’s registration and to related preparation, instruction, transportation arranged or provided by Millfort, equipment use, breaks, meals, overnight stays, and presence at any activity site. If I sign a standing or electronic version, it also applies to later Millfort activities for one year from the date signed unless a new agreement is required.

2. Activities Covered

Covered activities include, without limitation: firearms safety and marksmanship instruction; live-fire and dry-fire exercises; use, handling, storage, loading, unloading, transport, and discharge of firearms and ammunition; range activities; running, rucking, strength or conditioning workouts; hiking, trail use, outdoor navigation, camping, campfires, cooking, water activities incidental to an event, and exposure to wilderness conditions; skydiving and related aircraft, ground training, equipment, landing, and drop-zone activities; clinics, demonstrations, meetups, competitions, social events, volunteer activities, and transportation connected with any of the foregoing (collectively, “Activities”).

3. Participant Eligibility, Health, and Disclosure

I represent that the information I provide is accurate and that I am physically, mentally, and legally able to participate. I will disclose before participation any medical condition, allergy, medication, pregnancy, disability, recent injury, impairment, or other circumstance that could affect safe participation. I understand that Millfort does not provide medical advice or guarantee my fitness for an Activity. I will obtain medical clearance when appropriate and carry necessary medication, including rescue medication. I will immediately stop and notify staff if I experience pain, dizziness, shortness of breath, confusion, unsafe fatigue, or another concerning symptom.

I will not participate while impaired by alcohol, cannabis, illegal drugs, prescription medication, fatigue, illness, or any condition that could reduce safe judgment or performance. I authorize Millfort to deny, suspend, or end my participation without refund when staff reasonably believe safety, eligibility, conduct, or compliance is at issue.

4. Acknowledgment of Inherent and Other Risks

I understand that the Activities are hazardous and may cause property damage, emotional distress, serious bodily injury, permanent disability, paralysis, illness, or death. Risks may arise from my actions or inaction; the actions or inaction of other participants, instructors, volunteers, or third parties; equipment failure or misuse; facility or land conditions; weather; wildlife; vehicles or aircraft; delayed emergency response; and the ordinary negligence of one or more Released Parties. Risks include known and unknown, foreseeable and unforeseeable conditions.

Firearms and range risks

  • Gunshot wounds; death; permanent injury; ricochet, fragmentation, splashback, muzzle blast, noise, recoil, hot brass, lead or chemical exposure, burns, and eye or hearing damage.
  • Firearm or ammunition malfunction; negligent or unintentional discharge; unsafe muzzle direction; mistaken target identification; crossfire; handling by other persons; and failure or misuse of firearms, holsters, targets, barriers, protective equipment, or range systems.
  • Movement with firearms; drawing, loading, unloading, clearing, positional shooting, low-light conditions, and live-fire exercises near other persons.

Fitness, running, hiking, and camping risks

  • Falls; collisions; overexertion; dehydration; heat illness; hypothermia; cardiac or respiratory events; muscle, tendon, joint, head, neck, or spinal injury; traffic; poor visibility; and uneven, steep, wet, loose, or obstructed terrain.
  • Severe weather, lightning, fire, smoke, water hazards, insects, poisonous plants, wildlife, foodborne illness, remote locations, lack of cellular service, getting lost or separated, and delayed rescue or medical care.

Skydiving and aviation risks

  • Aircraft operation, boarding, flight, exit, freefall, parachute deployment, canopy flight, equipment malfunction, entanglement, collision, off-site or hard landing, changing wind or weather, and actions of pilots, instructors, tandem masters, packers, other jumpers, or ground personnel.
  • Rapid changes in altitude or pressure, high speed, impact, and the possibility of catastrophic injury or death even when equipment and procedures function as intended.

Transportation and general event risks

Motor vehicle collision, loading or unloading, roadside hazards, acts of other drivers, theft, loss of personal property, facility conditions, crowds, and negligent acts or omissions.

5. Knowing and Voluntary Assumption of Risk

I knowingly and voluntarily accept and assume all risks of the Activities, whether known or unknown, inherent or otherwise, including risks arising from the ordinary negligence of any Released Party, to the fullest extent permitted by South Carolina law. I choose to participate despite these risks and accept full responsibility for my participation, conduct, equipment, and safety decisions.

6. Release and Waiver of Liability

To the fullest extent permitted by law, I, for myself and for my heirs, estate, personal representatives, guardians, successors, and assigns, release, waive, and forever discharge the Released Parties from all claims, demands, damages, losses, liabilities, actions, or causes of action arising out of or related to the Activities, including claims for personal injury, death, property damage, medical expenses, loss of consortium, or other loss caused in whole or in part by the ordinary negligence of a Released Party.

This release does not waive claims that cannot lawfully be waived, including liability established by a final judgment to have resulted from gross negligence, recklessness, willful or intentional misconduct, or another non-waivable duty. Nothing in this Agreement is intended to release a product manufacturer from a claim that cannot lawfully be released.

7. Covenant Not to Sue and Indemnification

I agree not to bring or maintain a claim against a Released Party that is released by this Agreement. I will indemnify, defend, and hold harmless the Released Parties from third-party claims, damages, judgments, costs, and reasonable attorneys’ fees to the extent caused by my negligent, reckless, intentional, unlawful, or unsafe act or omission; my violation of law, facility rules, or instructions; or my damage to property. This indemnity does not require me to indemnify a Released Party for that party’s gross negligence, recklessness, or willful or intentional misconduct.

8. Rules, Instructions, and Equipment

I will follow all laws, posted rules, safety briefings, range commands, instructor directions, land-use restrictions, and provider requirements. I will ask questions whenever an instruction or condition is unclear. I will use required protective equipment and inspect personal equipment before use. I will not exceed my training, ability, or comfort level. Millfort may alter or cancel an Activity because of weather, staffing, safety, site conditions, or other circumstances.

9. Firearms-Specific Representations

If participating in a firearms-related Activity, I represent that I may lawfully possess and handle every firearm and item I bring or use; I am not prohibited by federal, state, or local law; and I will truthfully disclose my level of experience. I will treat every firearm as loaded, keep the muzzle in a safe direction, keep my finger off the trigger until authorized and ready to fire, know my target and what is beyond it, and obey every cease-fire or stop command immediately. I will not bring unauthorized weapons, ammunition, modifications, or equipment. Millfort may inspect or prohibit equipment and may remove any person for unsafe conduct.

10. Skydiving and Third-Party Providers

If participating in skydiving, I understand that the drop-zone operator, aircraft operator, instructor, tandem master, equipment owner, and other providers control portions of the Activity and may impose separate eligibility, weight, health, training, insurance, and waiver requirements. Millfort does not warrant or guarantee any independent provider, aircraft, parachute system, weather decision, or outcome. Signing this Agreement does not replace a provider’s waiver, and failure to satisfy provider requirements may prevent participation.

11. Emergency Care and Evacuation

If I am injured or become ill and cannot make or communicate a timely decision, I authorize Millfort and its personnel to provide reasonable first aid and to obtain emergency evaluation, treatment, medication, ambulance transport, air evacuation, or hospitalization deemed reasonably necessary. I understand that medical care may be delayed or unavailable in remote areas. I am financially responsible for medical, rescue, evacuation, and transportation charges not covered by insurance. I release the Released Parties from claims arising from good-faith emergency assistance or the decision to seek assistance, except to the extent such claims cannot lawfully be waived.

12. Insurance and Personal Property

I understand that Millfort does not provide health, accident, disability, life, property, travel, or evacuation insurance for me unless expressly stated in writing. I am responsible for determining and maintaining appropriate insurance. I accept responsibility for loss of or damage to my firearms, equipment, vehicle, clothing, valuables, and other property, except to the extent caused by conduct that cannot lawfully be released.

13. Photo, Video, and Publicity Choice

Participants must select one option during registration. This choice regarding media does not affect eligibility to participate, except where recording is integral to instruction or safety review.

Yes: I grant Millfort permission to photograph, record, edit, reproduce, and use my name, image, voice, likeness, and statements from the Activities for lawful educational, promotional, documentary, and social-media purposes, without compensation. I waive approval rights and release claims arising from authorized use.

No: I do not grant promotional media permission. I understand incidental appearance in crowd or background imagery may not always be avoidable, and safety or instructional recordings may be retained for legitimate operational purposes.

14. Privacy and Electronic Signatures

Millfort may collect and retain information reasonably needed for registration, safety, communication, incident response, payment administration, legal compliance, and recordkeeping. I consent to receiving event-related communications at the contact information I provide. If I sign electronically, I consent to use of electronic records and signatures, agree that my electronic action is intended as my signature, and may request a paper copy. I am responsible for providing accurate information and safeguarding any signature link sent to me.

15. Governing Law, Venue, Severability, and Construction

South Carolina law governs this Agreement, without regard to conflict-of-law principles. Any action concerning this Agreement or the Activities must be brought in a state or federal court with jurisdiction over York County, South Carolina, unless applicable law requires otherwise. If any provision is held invalid or unenforceable, it will be modified only to the minimum extent necessary and the remaining provisions will remain effective. This Agreement is intended to be as broad and inclusive as South Carolina law permits, but it will not be construed to waive a right that cannot legally be waived.

16. Entire Agreement, No Reliance, and Opportunity to Review

This Agreement contains the entire agreement concerning its subject matter and may be changed only in a writing signed by Millfort and me. I am not relying on an oral promise or assurance that contradicts this Agreement. Headings are for convenience only. I have had sufficient time to read this Agreement, ask questions, and seek independent legal advice. I understand its terms and sign freely and voluntarily.

17. Parent or Legal Guardian Agreement for Minor Participant

Complete the parent or guardian fields if the participant is under 18. I am the minor participant’s parent or legal guardian and have legal authority to sign. I have read this entire Agreement and consent to the minor’s participation. To the fullest extent permitted by law, I individually agree to all provisions of this Agreement, including assumption of risk, release, covenant not to sue, indemnification, emergency-care authorization, governing law, and venue. I agree that my own claims arising from the minor’s participation are released to the same extent as if I were the participant. I understand that the enforceability of a parent’s pre-injury release of a minor’s claims may be limited by law, and this paragraph does not claim to waive rights that cannot lawfully be waived.

I authorize the adult event leader identified by Millfort, or another responsible adult designated in writing, to obtain emergency medical care for the minor when I cannot be reached promptly. I remain responsible for all resulting costs.

Ready to sign? Print this agreement and complete the participant details below at check-in with Millfort staff before any activity. A parent or legal guardian must attend and complete the guardian fields for a participant under 18.
